This Privacy Policy is also intended to explain how your Personal Data will be handled by MSC mobile app, trading as "myMSC" ("myMSC", "we", "our" and "us") and sets out the information including the personal data detailed below relating to you.

By using this Website, you agree to the collection, use, and disclosure of your personal data by MSC in accordance with this Privacy Policy, where and as permitted by applicable laws and regulations of Personal Data, including but not limited to the provisions of the Swiss Federal Act on Data Protection ( "FADP") and the EU General Data Protection Regulation 2016/679 ( "GDPR") and any other applicable law with respect to all Personal Data (as defined by the GDPR and FADP). Please carefully read and agree to this Privacy Policy before accessing and using this Website. For Personal Data processing matters which need your separate consent, we will obtain your separate consent before processing your Personal Data in accordance with legal requirements.

WHAT PERSONAL DATA WE COLLECT

MSC collects and processes certain Personal Data from you and your mobile device. For the purposes of this Privacy Policy, "Personal Data" means all kinds of information recorded electronically or otherwise in relation to identified or identifiable natural persons. It does not include Personal Data or aggregate information after anonymous processing.

USES MADE/PURPOSE OF COLLECTION OF THE PERSONAL DATA

myMSC provides a wide variety of container shipping services to its clients. The following table details the key context for which ("Legal Basis") and why ("Purposes") we collect, obtain, and process your Personal Data:

a) Necessary for entering or performance of a contract

It is necessary to process your Personal Data to enter into and perform our services and provide the corresponding solutions services or support ("myMSC Services").

IMPORTANT You are obliged to provide us with your Personal Data as it is necessary in the Sign In Form to register in myMSC Services. In the event that you do not wish to provide us with your Personal Data for the above purposes, you may not be able to access myMSC Services.

We may obtain, collect and process your Personal Data where we have a legitimate interest to do so part of your engagement with us as a recipient of myMSC Services:

  • Improving Website and App Functionality and Efficiency
  • To provide, improve, test and monitor the effectiveness of the myMSC app;
  • To monitor metrics such as total number of visitors, traffic data and demographic patterns and other statistics provided from PlayStore and AppStore;
  • To ensure the content on the app is presented in the most effective manner for you and to enhance your use of the myMSC Services.

  • To process and communicate with you if you choose to cancel your myMSC account, and/or request we provide you with a report on the data held about you.

IMPORTANT Before we process your Personal Data to pursue our legitimate interests for the above purposes, we determine if such processing is necessary, and we carefully consider the impact of our processing activities on your fundamental rights and freedoms. On balance, we have determined that such processing is necessary for our legitimate interests and that the processing which we conduct does not adversely impact on these rights and freedoms.

c) Compliance with a legal obligation

It is necessary to process your Personal Data in order to comply with legal obligations to which we are subject. We obtain, collect and process your Personal Data in order to comply with the following legal obligations:

  • To comply with Chinese Personal Data Protection Law; and
  • To comply with other applicable laws (Corporate Law).

MARKETING

We will send you relevant updates, news and promotions about our services via email or SMS, but only if you have previously agreed to receive these communications, which may include marketing communications.

We also like to hear your views to help us improve our Services, so we may contact you with questionnaires. You always have the choice about whether to take part in our questionnaires.

OPTING OUT OF MARKETING ACTIVITY

You may choose to unsubscribe at any time from such communications by either clicking the unsubscribe link, or the link to edit your email preferences in the footer of the email you receive, or by following the opt-out options at the end of the SMS you receive. When an opt-out request is made, your details are marked in our database with an unsubscribe "flag" so that you do not receive further direct marketing from us. If we know your postal address, it will be added to a suppression list to be excluded from any future posted direct marketing. Opt-out requests exclude any non-marketing communications that we deliver (by email, post, phone calls, SMS, or other means) that are related to you as our customer or any other the previous consents that you have signed with us (e.g. Shipping updates, Career updates, Promotional updates…).

REMARKETING

Remarketing consists of creating personalized ad campaigns for those users who have already visited myMSC website services by previously consenting this purpose.

We use third party vendors to design and run advertising campaigns on online platforms. Third party vendors, including Google, show our ads on sites across the internet by using cookies to generate ads based on your past visits to myMSC website. These advertising campaigns may appear on your phone or device to show information about MSC's products and services. You can opt out of Google's use of cookies by visiting Google's Ads Settings.

DO-NOT-TRACK DISCLOSURE AND THIRD-PARTY TRACKING

MSC Group may engage with customers or prospective customers through social media channels, however no Personal Data is collected by us through these channels, unless explicit consent is provided by you.

PERSONAL DATA WE COLLECT FROM OTHER SOURCES

From time to time, we may obtain information about you from third-party sources and third-party data providers. We make our best efforts to ensure such third parties are legally and contractually permitted to disclose such information to us. Examples of the information we receive from other sources include demographic information, device information, location, and online behavioural data (such as information about use of other websites, page view information, search results and links). We use this information, alone or in combination with other information (including Personal Data) we collect, to enhance our ability to provide relevant marketing and content to you and to develop and provide you with more relevant updates, news, promotions, features and services.

NOT SELLING PERSONAL DATA

We will not sell and have never sold the Personal Data we collect through this Website.

HOW PERSONAL DATA IS SECURED AND RETAINED

Personal Data will be collected and stored in good faith, in a proportionate manner, for the business purposes indicated above. In order to protect the Personal Data, we have implemented state-of-the-art technical and organizational measures. We will retain your Personal Data for no longer than is necessary to fulfil the business purposes for which it was collected. The precise period will depend on the reason why it was collected. Any transfer of your Personal Data ( "EEA") to an area outside of the EEA considered a non-adequate jurisdiction will only be made where appropriate safeguards have been put in place.

SECURITY AND PRIVACY

MSC takes every precaution to protect the confidentiality and security of the Personal Data of Website visitors or registered users by implementing industry-standard security safeguards, such as firewalls, or SSL certification coupled with carefully developed security procedures by our IT department. These measures are designed to protect visitors and registered users' information from loss, misuse or unauthorised alteration. Using physical, electronic and procedural safeguards, we restrict access to Personal Data to employees on a “need-to-know” basis for business purposes.

a) Play Store

All developers that have an app published on Google Play must complete the Data safety form, including apps on internal, closed, open, or production testing tracks.

Even developers with apps that do not collect any user data are required to complete this form and provide a link to their privacy policy. In this case, the completed form and privacy policy can indicate that no user data is collected or shared.

All developers in PlayStore must how they collect and handle user data for the apps they publish on Google Play, and provide details about how they protect this data through security practices like encryption.

On myMSC Content Page in Play Store, we provide this information on the new Data safety section (Policy > App content). The information you provide will be reviewed by Google as part of the app review process. It will be shown on your store listing to help Google Play users understand how you collect and share data before they download your app.

b) App Store

On the App Store, mymsc app come from us as identified developers who have agreed to follow Apple guidelines, and are securely distributed to users with cryptographic guarantees against modification. Mymsc app and each update is reviewed to evaluate whether it meets requirements for privacy, security, and safety. This process, which is being constantly improved, is designed to protect users by keeping malware, cybercriminals, and scammers out of the App Store.

Our website may, from time to time, contain links to and from websites of our partners’ networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any Personal Data to the websites. MSC does not endorse or make any representations about third-party websites. Any Personal Data you choose to give to unrelated Third Parties is not covered by this Privacy Policy.

CHILDREN AND VULNERABLE PERSON

Persons that don't have a legally age recognized as adults, are not permitted to open a myMSC Account and operate any of the functionalities that the app can provide. We ask that persons under that legal range do not submit any Personal Data to us or use our services. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental’s or guardian’s consent, we take steps to remove that Personal Data from our servers.

A "vulnerable person" means a natural person who has the capacity to make his or her own decisions but who, because of individual circumstances, may require assistance to do so (for example, visually impaired); and/or has limited capacity to make his or her own decisions and who requires assistance to do so (for example, persons with intellectual disabilities or mental health difficulties).
